UTZ CRUNCHY TUNES ULTIMATE FAN EXPERIENCE TWITTER SWEEPSTAKES
DESCRIPTION OF THE SWEEPSTAKES:
Utz Quality Foods, LLC (“Sponsor”) is happy to present the UTZ CRUNCHY TUNES ULTIMATE FAN EXPERIENCE (the “Sweepstakes”) beginning on October 3, 2019, at 12:00 p.m. EST and ending on October 9, 2019, at 11:59 p.m. EST (the “Entry Period”).
AGREEMENT TO OFFICIAL RULES:
Participation in the Sweepstakes constitutes participant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning the Grand Prize is contingent upon fulfilling all requirements set forth herein. The Sponsor’s computer will serve as the official clock for the Sweepstakes.
ELIGIBILITY: The Sweepstakes is open only to legal residents of the fifty (50) United States and Washington, DC who are eighteen (18) years of age or older (except in the case of legal residents of certain jurisdictions where the legal age of majority is greater than eighteen (18) years of age, such legal age of majority) at the time of entry. Employees, officers, and directors (including immediate family members (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) of Sponsor, the MLB Entities and each of their respective parents, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers, advertising and promotion agencies, and any and all other companies associated with the Sweepstakes are not eligible to participate or win the Prize (defined below). The “MLB Entities” shall mean the Office of the Commissioner of Baseball (“BOC”), its Bureaus, Committees, Subcommittees and Councils, MLB Advanced Media, L.P., Major League Baseball Properties, Inc., The MLB Network, LLC, the Major League Baseball Clubs (“Clubs”), each of their parent, subsidiary, affiliated and related entities, any entity which, now or in the future, controls, is controlled by, or is under common control with the Clubs or the BOC and the owners, general and limited partners, shareholders, directors, officers, employees and agents of the foregoing entities. The Sweepstakes is subject to all applicable federal, state, territory, provincial and local laws, rules and regulations.

HOW TO ENTER:
No Purchase Necessary. To enter, you must (a) have a valid, public (i.e., not protected) Twitter account and be a follower of @utzsnacks, and (b) during the Entry Period, from your Twitter account, Retweet a post concerning the Sweepstakes which shall be Tweeted by @utzsnacks together with a message identifying your favorite walk up song and MLB player name, to remain publicly posted through October 14, 2019 (“Entry”).
Your Entry must comply with (i) Content Restrictions (as set forth in the Content Restrictions section below), and (ii) Twitter Terms of Service and Twitter Rules available at twitter.com/tos. All information submitted online via Twitter is subject to, and will be treated in a manner consistent with, Twitter’s Privacy Policy accessible at: twitter.com/privacy and Twitter Terms of Service and Twitter Rules (see above); all information submitted online via Twitter and shared with applicable MLB Entities per entrants’ Twitter account settings, or online directly to applicable MLB Entities in connection with the Prize Notification process, is subject to, and will be treated in a manner consistent with, Major League Baseball’s website (MLB.com) Privacy Policy accessible at: mlb.com/privacy. All information submitted online via Twitter and shared with Sponsor per entrants’ Twitter account settings, or online directly to Sponsor in connection with the Prize Notification process, is subject to, and will be treated in a manner consistent with Utz Quality Food’s website (Utzsnacks.com) Privacy Policy accessible at: utzsnacks.com/pages/privacy-policy.
If you do not have a Twitter account, visit twitter.com and register in accordance with the enrolment instructions for a free Twitter account. Data and usage rates may apply to the download and use of the Twitter application. The time of receipt of any valid Twitter entry shall be the time such valid entry becomes available to Sponsor on twitter.com. Any Entry that does not comply with the Content Restrictions or otherwise with these Official Rules, and any that are removed or hidden prior to the prize drawing date are void.
The entry limit is one per person overall.
CONTENT RESTRICTIONS: Entrants must not include any of the following content (the "Content Restrictions") in any Entry: (a) pornography, adult-oriented content or any other sexually-explicit material; (b) materials relating to lotteries or gambling; (c) explicit language or content, images of violence, or promotion of illegal activities; (d) content in violation of intellectual property rights or laws; (e) libelous, defamatory, disparaging, tortious or slanderous materials; (f) content that denigrates, disparages or reflects negatively on the Sponsor or MLB Entities, their owners and employees, or the game of baseball; (g) tobacco, e-cigarettes, alcohol or drugs; (h) dangerous stunts; (i) real weapons of any kind including, but not limited to, guns, knives or projectiles; (j) material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation, age or any other basis protected by federal, state, territory, provincial or local law, ordinance, or regulation; (k) individuals under legal age of majority without providing a signed release from parent or legal guardian; (l) audio and/or visual content owned by any third party (e.g., recorded music; pre-produced video, etc.) or material that violates or infringes another's rights, including but not limited to privacy, publicity or intellectual property rights, including copyright infringement; (m) material not created by the entrant, that is unlawful, or otherwise in violation of or contrary to the laws or regulations in any state where the entry is created; and (n) any brand names or trademarks other than those of Sponsor. Any Entry that does not comply with the foregoing, in the sole discretion of Sponsor, will be disqualified.
SELECTION OF THE WINNER:
The potential winner of the Sweepstakes will be selected by random drawing conducted by Sponsor or its agent on or about October 10, 2019 from among all eligible entries received.
Winner will be notified via Twitter direct message no more than 7 days following the drawing with prize claim instructions, including deadlines for any documents required by Sponsor to receive the prize. The potential winner may be required to submit his/her valid social security number and/or other identification to Sponsor and may be required to execute, have notarized and return an Affidavit of Eligibility and Release of Liability and, unless prohibited by law, Publicity, within five (5) days of the date of issuance. If a selected winner cannot be contacted, is ineligible, fails to claim a prize or fails to return any required forms, the selected winner will forfeit the prize and an alternate winner will be selected, time allowing. Only three alternate winners will be selected, after which unclaimed prizes will remain unawarded.
All eligible entrants have an equal chance of winning.
GRAND PRIZE: One (1) Grand Prize Will Be Awarded. Winner will receive two (2) tickets for winner and one (1) guest to attend one game of the 2019 World Series presented by Youtube TV (the “Game”), access for winner and one (1) guest to attend pre-Game batting practice, two (2) Authentic Jerseys, and travel and hotel accommodations all as determined by Sponsor. Approximate retail value $4,500.
PRIZE CONDITIONS: All prize details, including seat locations at the Game and exact jersey size and style, shall be determined in the sole and absolute discretion of Sponsor. Winner is fully responsible for any and all applicable federal, state, territory, provincial and local taxes (including income and withholding taxes). All costs and expenses associated with the prize acceptance and use not specified herein as being provided, including but not limited to lodging, transportation costs, meals, gratuities and other expenses incurred by accepting the prize are the sole responsibility of the winner. The prize is non-transferable and non-assignable, with no cash redemption except at Sponsor’s sole and absolute discretion. Sponsor reserves the right to substitute the Prize (or any portion thereof) with a prize of comparable or greater value at its sole and absolute discretion. TRANSPORTATION TO/FROM THE GAME, EVENT OR EXHIBITION AND LODGING IS INCLUDED. Seat locations at the game and, unless otherwise stated in the prize description, exact game/event/exhibition date shall be determined in the sole discretion of Sponsor. Winner’s guest(s) must be of legal age of majority in his/her(their) jurisdiction(s) of residence (and at least eighteen (18) years of age), unless accompanied by a parent or legal guardian. Major League Baseball game, event and exhibition dates and times are determined in the sole discretion of the Office of the Commissioner of Baseball and/or the applicable Major League Baseball Club, as applicable, and may be subject to change. The terms and conditions of the tickets awarded as part of the Prize will govern in the event a legal game, event or exhibition, as defined by Major League Baseball, is not played or held, as applicable, due to weather conditions, an act of God, an act of terrorism, civil disturbance or any other reason. Winner and his/her guest(s) agree to comply with all applicable ballpark and venue, as applicable, regulations in connection with the Prize. Sponsor and the applicable MLB Entities reserve the right to remove or to deny entry to the Winner and/or his/her guest(s) who engage(s) in a non-sportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person at the game, event or exhibition. Released Parties (defined below) will not be responsible for weather conditions, Acts of God, acts of terrorism, civil disturbances, work stoppage or any other natural disaster outside their control that may cause the cancellation or postponement of any Major League Baseball game, event or exhibition. Major League Baseball game, event and exhibition tickets awarded as prizes may not be resold or offered for resale or used for any commercial or promotional purpose whatsoever. Any such resale or commercial or promotional use may result in disqualification and Prize forfeiture, and may invalidate the license granted by the game, event or exhibition ticket(s).
WAIVER OF LIABILITY/PUBLICITY RELEASE: By participating in the Sweepstakes and submitting an entry, each entrant agrees to (a) be bound by these Official Rules, including all entry requirements, and (b) waive any and all claims against Sponsor, the MLB Entities, Twitter, Inc. (“Twitter”), and each of their respective parents, affiliated companies, subsidiaries, officers, directors, employees, agents, licensees, distributors, dealers, retailers, printers, representatives and advertising and promotion agencies, and any and all other companies associated with the Sweepstakes, and all of their respective officers, directors, employees, agents and representatives (collectively, “Released Parties”) for any injury, damage or loss that may occur, directly or indirectly, in whole or in part, from the participation in the Sweepstakes or from the receipt or use of the prize (or any portion thereof) or any travel or activity related to the receipt or use of the prize (or any portion thereof). By entering this Sweepstakes, each entrant gives his/her express permission to be contacted by Sponsor by telephone, email and/or postal mail for Sweepstakes purposes. The winner, by acceptance of the Prize, grants to Sponsor, the MLB Entities, and each of their respective designees the right to publicize the winner’s name, address (city and state/territory/province of residence), photograph, voice, statements and/or other likeness and prize information for advertising, promotional, trade and/or any other purpose in any media or format now known or hereafter devised, throughout the world, in perpetuity, without limitation and without further compensation, consideration, permission or notification, unless prohibited by law.
GENERAL ENTRY TERMS: By submitting an Entry, each entrant agrees that his/her entry is an original work of authorship and that he/she owns all right, title and interest in the entry as of the date of submission or has all necessary rights and authorizations to submit it and the express permission of all individuals, content and materials embodied in the entry to submit it for possible use as provided herein and irrevocably grants Sponsor, the MLB Entities and their affiliates, legal representatives, assigns, agents and licensees, the unconditional, unlimited and perpetual right and permission to reproduce, encode, store, copy, transmit, publish, post, broadcast, display, publicly perform, adapt, exhibit and/or otherwise use or reuse the entrant’s Entry as submitted or as edited/modified in any way by the Sponsor or MLB Entities, in their sole discretion, as well as to use (or not use) entrant's name, likeness, photograph, and/or statements in this Sweepstakes in any and all media without limitation, worldwide and throughout perpetuity, without additional compensation, notice to, or approval from entrant or any other party. Each entrant understands and agrees that although he/she has granted Sponsor the right to use his/her Entry as stated hereinabove, Sponsor, in its sole discretion, may elect not to so use any said Entry. EACH ENTRANT REPRESENTS, UNDERSTANDS AND ACKNOWLEDGES THAT HE/SHE WILL NOT BE PAID FOR OR RECEIVE ANY FORM OF COMPENSATION OR ROYALTY (OTHER THAN THE PRIZE STATED HEREIN IF SELECTED AS A WINNER) IN EXCHANGE FOR GRANTING SPONSOR AND THE MLB ENTITIES THESE RIGHTS OR FOR ANY SUBSEQUENT USE OF SUCH ENTRY BY SPONSOR OR THE MLB ENTITIES. Each entrant waives all intellectual property rights, privacy/publicity rights or other legal or moral rights that might limit or preclude Sponsor's and MLB Entities’ use of the respective Entry and agrees not to sue or assert any claim against Released Parties (as defined below) arising out of or connected to the use of the Entry, including but not limited to, claims of copyright or trademark infringement, false endorsement, libel, slander, defamation or infringement of rights of publicity or privacy. If requested, entrant will sign any documentation that may be required for Sponsor or its designees to make use of the non-exclusive rights entrant is granting to use the Entry. Released Parties are not responsible for lost, late, stolen, damaged, incomplete, invalid, un-intelligible, garbled, delayed or misdirected Entries -- all of which will be void. This Sweepstakes is in no way sponsored, endorsed, or administered by, or associated with, Twitter. Persons who tamper with or abuse any aspect of the Sweepstakes or attempt to undermine the legitimate operation of the Sweepstakes by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other entrant or any representative of Sponsor and/or the MLB Entities or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries will be void. Any attempt to deliberately damage the content or operation of this Sweepstakes is unlawful and subject to legal action by Sponsor, the MLB Entities and/or their respective agents. Sponsor shall have the sole right to disqualify any entrant for violation of these Official Rules or any applicable laws relating to the Sweepstakes, and to resolve all disputes in its sole discretion. Released Parties (a) make no warranty, guaranty or representation of any kind concerning the prize (or any portion thereof), and (b) disclaim any implied warranty.
CAUTION: ANY ATTEMPT TO DELIBERATELY UNDERMINE THE CONTENT OR LEGITIMATE OPERATION OF THIS SWEEPSTAKES MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY ENTRANT RESPONSIBLE FOR THE ATTEMPT, AND SPONSOR, THE MLB ENTITIES AND THEIR RESPECTIVE AGENTS RESERVE THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY PERSON OR PERSONS RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
NOT AN OFFER OR CONTRACT OF EMPLOYMENT: Under no circumstances shall the submission of an Entry into the Sweepstakes, the awarding of a prize, or anything in these Official Rules be construed as an offer or contract of employment with Sponsor and/or any other entity associated with the Sweepstakes.
